1 Acceptance of Master Services Agreement
By accessing, registering for, or using the messaging services, portals, APIs, and wholesale infrastructure provided by Bulk5 ("Company", "we", "us", or "our"), you ("Client", "Reseller", or "User") agree to be bound by these Terms of Service. If you are entering into this Agreement on behalf of a company or legal entity, you represent that you possess the requisite authority to bind such entity.
2 Telecom Regulatory Compliance & TRAI DLT Mandate
All messaging traffic dispatched within or into the territory of India is subject to the Telecom Commercial Communications Customer Preference Regulations (TCCCPR) enacted by the Telecom Regulatory Authority of India (TRAI).
- Clients and Resellers must possess an approved Principal Entity (PE) registration and approved Sender IDs (Headers) prior to dispatching transactional or service messaging.
- Message templates must match approved DLT registered formats verbatim. Any attempt to bypass variable character caps, inject unapproved URL shorteners, or spoof headers constitutes a material breach resulting in immediate termination.
- Promotional broadcasts must strictly conform to DND (Do Not Disturb) national preference scrubbing and time window restrictions (09:00 AM to 09:00 PM local recipient time).
3 Acceptable Use Policy (AUP) & Zero Spam Tolerance
The Platform may only be utilized for lawful commercial and transactional communication. You expressly warrant and agree that you shall NOT dispatch, broadcast, or facilitate:
Prohibited Content Categories:
• Phishing, social engineering, OTP harvesting, or fraudulent banking scams.
• Illegal gambling, unauthorized cryptocurrency promotions, or unlicensed lending schemes.
• Malware, spyware, deceptive APK downloads, or spoofed brand domains.
• Harassment, unsolicited bulk spam, hate speech, or defamatory communications.
4 Reseller & Sub-Reseller Commercial Obligations
Resellers operate as independent commercial entities. Resellers are solely responsible for:
- Performing identity and KYC verification on all downstream retail clients and sub-resellers created under their account.
- Ensuring that downstream users do not engage in unauthorized messaging or spam activities.
- All financial transactions, credit disbursements, and billing disputes arising between the Reseller and their retail clients.
5 Wallet Balances, Unit Rates & Non-Refundability
Our services operate on a pre-funded wallet balance model. Wallet credits are deducted upon message submission and gateway routing based on prevailing unit rates. All pre-funded balance allocations, setup fees, and wholesale credit purchases are strictly non-refundable once activated or consumed.
6 Carrier Latency, Route SLAs & Limitation of Liability
While Company maintains Tier-1 interconnects and high-availability gateway infrastructure targeting 99.99% uptime, actual final handset delivery is contingent upon recipient mobile handset availability, carrier network congestion, roaming conditions, and handset-level filtering. In no event shall Company be liable for indirect, incidental, consequential, or punitive damages.
